Can a lanlord not renew my lease because I asked him to file a claim because someone pushed me down stairs.?
I got into a physical argument with my neighbor and she pushed me down 7 stairs. I did grab her first. She filed batter charges against me. I went to court and they were all dropped due to her not showing up. She doesn’t work and has no money. I have some medical bills my insurance doesn’t cover. I know she won’t pay so I asked the landlord of the building where I fell if he could file a claim with his homeowners insurance to cover the additional expenses my insurance doesn’t cover. He told me no that he contacted his lawyers and they have no responsiblity in this at all. He stated it’s a free country I can do what I want but it’s bad business. Now I don’t want to sue him I just want to get my shoulder fixed. Now i’m afraid that he may not renew my lease in July and I don’t want to move because my kids school is right there help. I’m so worried he will kick us out.
Depends on local and state law, but if you are causing trouble by getting into fights with neighbors (even if you were acquitted in court on a technicality) could be sufficient grounds to want you out.
You can still try to sue, at least. But your grounds might be that he was negligent in letting beligerent people like yourself live there and his defense would be that he kicked you out.
